Public Broadcasting Service (PBS) has a significant interest in the outcome of this proceeding as PBS-member public television stations are “public broadcasting entities” within the meaning of 17 U.S.C. § 118 and rely on the Section 118 license for the musical compositions included in their programming. PBS is a non-profit entity committed to serving a noncommercial, educational purpose, and its educational programming is made freely available to the American people. PBS—along with National Public Radio—has participated in every Section 118 proceeding since the inception of the Section 118 statutory license.
