Statement of significant interest
BMI, ASCAP, and SESAC, as "Music Claimants," represent copyright owners of works contained in programming that is secondarily transmitted by cable systems pursuant to the Section 111 license; therefore, Music Claimants have a "significant interest" in the cable compulsory license royalty rates within the meaning of 17 U.S.C. § 803(b)(1)(B) and 37 C.F.R. § 351.1(b)(1)(ii)(C). Music Claimants have participated in every cable royalty distribution proceeding and every cable rate adjustment proceeding since the enactment of the cable compulsory license in 1976. They have received, and expect to continue to receive, royalties from the Section 111 cable compulsory license.
